HC Deems Chanda and Deepak Kochhar’s Arrest Illegal: CBI Accused of Misusing Power

In the recent loan fraud case, the Bombay High Court has arrested Chanda Kochhar and her husband, Deepak Kochhar, for their involvement. It was stated on Monday by the Bombay High Court that the Central Bureau of Investigation (CBI) had arrested Chanda and Deepak Kochhar without conducting proper investigations and without legal sanction. Furthermore, the court stated that such misuse of power is improper.

Justice Anuja Prabhudessai and Justice NR Borkar of the division bench of the Bombay High Court had arrested Chanda Kochhar and Deepak Kochhar on February 6th. In January 2023, the second bench had confirmed their arrest.

The court mentioned that the Central Bureau of Investigation (CBI) is incapable of demonstrating coincidences or auxiliary evidence to justify the arrest. The court said that such arrests without using one’s mind and without legal sanction constitute an abuse of power.

The court also refused to accept the evidence of the investigating agency, as Kochhar had not cooperated with the investigation, leading to the arrest. The court stated that the accused have the right to remain silent during interrogation.
