16-Year-Old Rape Victim in Ahmedabad Granted Abortion at 27 Weeks
High Court Grants Permission for Abortion of 16-Year-Old Pregnancy
In the Gujarat High Court, an application for the abortion of a 16-year-old girl’s pregnancy was filed by Advocate Nisarg Shah on behalf of the minor. The girl is currently 27 weeks pregnant, and the High Court has granted approval for the abortion. The police in Ahmedabad’s Nikol area had registered a complaint against the accused in this case.
Court Orders Investigation of Nikol Police Inspector
In light of the seriousness of the case, Judge Samir Dave instructed the Medical Superintendent of Ahmedabad Civil Hospital, following the Medical Termination of Pregnancy (MTP) Act, to conduct a physical examination and submit a report to the court. The court also issued orders to the Nikol Police Inspector to ensure the girl is taken to the hospital and arrangements are made.
Lawyer to Receive Order Within 1 Week
After today’s medical examination of the minor, her medical report was presented before the High Court. After reviewing the report, Judge Samir Dave instructed the Medical Superintendent of Civil Hospital, Asarwa, to be present at the court within a week. Subsequently, the process of the abortion of the minor’s pregnancy will commence at Ahmedabad Civil Hospital.
Previous Approval for 16-Year-Old’s Abortion
Sixteen-year-old from Mahesana had previously received approval for an abortion at 18 weeks and 3 months of pregnancy under the Medical Termination of Pregnancy Act. In this case, the minor’s brother, Advocate Nidhi Barot, had filed an application, which was presented in Judge Samir Dave’s court. In this matter, the accused in the crime against the minor had also been charged by the local police.
DNA Testing Ordered for Pregnancy
The court had granted permission for the abortion under the Medical Termination of Pregnancy Act as per the directions given to the police inspector to manage the abortion process within a week. In addition to this, DNA testing of the pregnancy was also ordered in the case. It is worth noting that the court acknowledged that the minor’s pregnancy posed a high risk in this case.
